Terms of service
Last updated November 1, 2026
Packing Pending is a trade name of Lewiada Labs LLC, a Texas limited liability company. These terms are a contract between Lewiada Labs LLC (“we” or “us”) and the business that signs up for Packing Pending (“you”). They cover the weekly list, the mail add-on and this website. Our cancellation and refunds policy and our privacy page are part of them.
You agree to these terms when you tick the box at sign-up or start using Packing Pending. If you accept them for a business, you confirm that you’re allowed to bind it.
1. Who can sign up
Packing Pending is for businesses, not personal use. You must be at least 18. Give us accurate details when you sign up, and keep your email address current. We send your lists and every notice under these terms to that address.
2. What you get
- Each week we email you the homes newly listed for sale in the ZIP codes on your plan, with a map and a spreadsheet. Today the spreadsheet also has our vacancy filter’s mark and notes for each home, the listing agent’s name and contact details, and, for most homes, the owner’s name and mailing address.
- We aim to send your first list within three business days of sign-up, then one list a week. We don’t promise a day or time.
- We may change the list: the information it holds, the columns that carry it, how it looks and how we deliver it. The samples on our website show the list as it was when they were made. You’ll always get each week’s new listings for your ZIP codes with their addresses. If we drop something we advertise, such as the vacancy filter or owner names, we’ll email you before it changes.
3. What the list can and can’t tell you
- The vacancy filter estimates from each listing’s photos and description whether someone lives in the home. It can be wrong, and sometimes it can’t tell. We don’t promise that any home is lived in or empty.
- Any detail about a home can be missing, out of date or wrong, so some columns are blank for some homes. That includes the owner’s name and mailing address, and the agent’s contact details. Homes without a name are addressed to “Current Resident.”
- Listings can be late, missed, changed or taken off the market.
- We don’t promise any calls, bookings or other results.
- No area is exclusive. Other customers may get the same homes in the same ZIP codes.
4. How you may use the lists
While your subscription is active, you may use the lists to market your own business, for example by mail, flyers or visits to the homes. You may share them with a vendor that works for you, such as a printer or mail house, if it uses them only for your marketing. You may not:
- sell, share, publish or give the lists, or anything made from them, to anyone else
- use them to build or improve a product that competes with ours
- use them to decide anyone’s eligibility for credit, insurance, employment or housing, or for any other purpose covered by the Fair Credit Reporting Act. The lists aren’t consumer reports, and we aren’t a consumer reporting agency.
- use them to harass anyone, to discriminate in a way the law forbids, or for anything else illegal
- copy data from our website or service with automated tools, or try to see another customer’s data
Your marketing is your responsibility, and so is following the laws that apply to it, including postal rules, local rules on flyers, door-to-door visits and no-soliciting signs, and the rules for commercial email. If you email the listing agents on the list, you’re the sender: say who you are, include your postal address and a way to unsubscribe, and honor it promptly. If a homeowner or agent asks you to stop contacting them, stop, and tell us so we can leave them off future lists and mail.
When your subscription ends, including after a free trial, your right to use the lists ends too. Stop using them, and delete them within 30 days.
5. Trial, plans and billing
- Free trial. Your first 14 days are free. You add a card to start, and we charge it on day 15 unless you cancel before then. We email you a reminder about a week before your trial ends. Each business gets one free trial.
- Billing. Plans are billed monthly in advance to the card you gave us, starting on day 15. Your subscription renews each month until you cancel. Prices are on our website and don’t include taxes. We add sales tax where the law requires it.
- Changing ZIP codes. Email us the ZIP codes you want, and we’ll change them for your next list. If the new ZIP codes need a higher plan, the higher price starts with that list, and we charge the difference for the rest of that month. If they fit a lower plan, the lower price starts at your next billing date.
- Founding prices. A founding price stays the same for 12 months from your first charge while your subscription stays active. If you cancel, it ends and doesn’t come back if you sign up again. After the 12 months, your plan’s regular price applies.
- Price changes. We’ll email you at least 30 days before your price changes, including when a founding price ends. If you don’t want the new price, cancel before it starts.
- Failed payments. If a payment fails, we may pause your lists until it’s paid, and cancel your subscription if it stays unpaid.
- Disputed charges. If you think a charge is wrong, email us first. If you dispute a charge with your bank instead, we may pause your account until the dispute is settled. If it’s decided in our favor, you’ll pay the fees it cost us.
- Cancelling and refunds are covered by our cancellation and refunds policy. In short, you can cancel anytime, your plan ends at the end of the period you’ve paid for, and payments aren’t refundable.
6. Mail
This section applies if you add mail.
- Approval. Nothing mails until you approve the card. Before you approve it, check the phone number, your USDOT and TxDMV numbers, every claim and the spelling. Two rounds of changes are included. Mistakes in a card you approved are yours to pay to fix.
- Your materials. You confirm that you own or may use your name, your logo and everything else on a card you approve, including anything taken from your website or given to us. You also confirm that you have any approval your franchise agreement requires. We don’t contact franchisors.
- Our designs. The card designs we make are ours. Your name, logo and other materials stay yours. You may use a design we make only for mail sent through us while you subscribe. You may not copy it or give it to another printer.
- Which homes get cards. We mail the homes your settings choose. Unless you tell us otherwise, that’s the homes our vacancy filter marks as lived in.
- Delivery. The U.S. Postal Service delivers the cards, and we don’t control when. Some cards won’t be delivered.
- Pausing. We may refuse or pause any card or mailing, and we pause right away if anyone complains about one. Cards already sent to print can’t be stopped, and you pay for them.
- Price. Mail is billed at the price shown when you add it.
7. Our rights
- Packing Pending, the lists as we put them together, the vacancy filter and its marks, our maps, our designs and this website belong to us. You get no rights to them beyond using the lists as section 4 allows.
- If you send us ideas or feedback, we may use them without paying you or owing you anything.
- We may refuse to sign anyone up.
- We may pause or end your account if you break these terms, misuse the lists or don’t pay, or if a homeowner or a government agency complains about how you use them. If we end your account for one of these reasons, you get no refund.
- We may stop offering the weekly list or the mail add-on with 30 days’ notice. If we stop your plan partway through a month you’ve paid for, we’ll refund the unused part of that month. Changes to what the list includes are covered by section 2.
8. No warranties
We provide Packing Pending, the lists and the mail “as is” and “as available.” We make no promises beyond what these terms say. To the extent the law allows, we give no other warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, completeness or non-infringement, and any warranty that Packing Pending will work without interruption or errors.
9. Limit on our liability
To the extent the law allows, we aren’t liable for lost profits, lost business, lost data, or any indirect, incidental, special, consequential or punitive damages, even if we knew they were possible. Our total liability for all claims about Packing Pending or these terms is at most what you paid us in the 3 months before the event the claim is about. If we make a mistake in printing or mailing a card, our only duty is to reprint and remail the affected cards.
10. You cover our costs
You’ll defend us, and pay our losses, costs and reasonable lawyers’ fees, against any claim by someone else that arises from your use of the lists; your marketing, including mail, flyers and visits to homes; anything on a card you approve, or anything you give us; your licensing or your compliance with the law; or your breaking these terms.
11. Changes to these terms
We may change these terms. We’ll email you at least 30 days before a change takes effect and post the new version here with a new date. If you don’t agree, cancel before the change takes effect. If you keep your subscription after that, you accept the new terms. A change never applies to anything that happened before it took effect.
12. Disputes
Texas law governs these terms. Any lawsuit about Packing Pending or these terms goes to the state or federal courts in Travis County, Texas, and you and we both agree to those courts. Either of us may instead bring a claim in justice court if it qualifies. You and we each give up the right to a jury trial.
13. Other terms
- These terms, with our cancellation and refunds policy and our privacy page, are our whole agreement about Packing Pending.
- We send notices to the email address on your account. Send yours to support@packingpending.com.
- You may not transfer these terms to anyone else without our written consent. We may transfer them to a business that takes over Packing Pending.
- We aren’t responsible for delays or failures caused by events outside our reasonable control, such as postal delays, outages at services we rely on, storms or government action.
- If a court finds part of these terms unenforceable, the rest still applies. If we don’t enforce a term, we can still enforce it later.
- Sections 3, 4, 7, 8, 9, 10, 12 and 13 still apply after your subscription ends, and so does anything you owe us.
